TERMS AND CONDITIONS OF THE CONTEST AND PERSONAL DATA PROCESSING INFORMATION

GAME

The company Victoria VR, a.s., ID No. 09695346, with registered office at Václavské náměstí 796/42, Nové Město, 110 00 Prague 1, Czech Republic registered in the Commercial Register of the Municipal Court in Prague, file No. B 25843 ("Controller", "Company" or "We") created a game CQB Training Arena (“Game”).
The goal of the player of the Game is to reach the end of the Game with the character in the Game. According to the progress of the Game and its rules, the final time of the player is evaluated at the end of the game (“Time”).
At the end of the Game, the player is allowed to participate in a contest for prizes. Contest winners are determined by the Company based on the Time. The players with the fastest Time win (“Contest”).

CONDITIONS OF THE CONTEST

The Contest takes place from 09. 02. 2024 to 28.02.2024 (“Contest Period”). The Company may change Contest Period or cancel the Contest at any time.
The Contest is open to all persons who are 18 years of age or older (persons under 18 years of age may participate only with the consent of their legal guardian) (“Participants”).
Participants will include anyone who completes the Game during the Contest Period, agrees to be entered into the Contest, and enters their email and nickname.
Each Participant can only win once.
In the event that the winner cannot be contacted (e.g. due to incorrect contact details), the winner"s entitlement to the prize will cease without any compensation.
Prizes are always specified either in the Game or on the Company"s website or social media channels.
All winners will be notified of their winnings by e-mail and their nicknames might be also published on the website or social media of the Company.
If the winner fails to respond to the Company within 3 days of the date of the prize notification, the winner"s entitlement to the prize will cease without any compensation.
All Participants who in any way (even if only marginally or partially) fail to comply with these Terms and Conditions or the Game Rules are excluded from the Contest.
The Company may furthermore decide to exclude those Participants who are reasonably suspected of engaging in unfair, fraudulent or dishonest practices in the Contest.
The Company shall not be liable for any technical failures and malfunctions and functionality of the Game and shall not be liable for any damages incurred by a Participant through participation in the Contest, provided that such damages are not intentionally caused or caused by gross negligence.
The Company shall be entitled to suspend, withdraw or cancel the Contest or unilaterally amend or supplement these Terms and Conditions without refund.
Contest prizes may not be claimed by legal action or alternatively in money. Any prizes not claimed by either the alternate winner will be forfeited to the Company. The Company shall not be liable for any defects in the prizes or for any defects, damage or loss associated with the delivery of the prizes.
The Terms and Conditions of the Contest are governed by the valid and effective laws of the Czech Republic.

PROCESSING OF PERSONAL DATA

Within the Contest the Company might be the controller of personal data within the meaning of Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("Regulation").

CATEGORIES OF PERSONAL DATA

If you have registered for the Contest, we process the following categories of personal data:

  • Electronic contact details: e-mail address
  • Other personal data: nickname, Time

If you are selected as a winner of the Contest we might process the following categories of personal data:

  • Contact details: Name, surname and address

LEGAL TITLE AND PURPOSE OF PROCESSING

We process personal data for the following reasons:

Performance of contractual obligations

  • We process your email address so that we can contact you if you are designated as one of the winners of the Contest.
  • If you are determined as one of the winners of the Contes and you win a prize in kind, we may ask you to provide us with your name and delivery address. We will process this personal data to send you the prize.
  • The nickname is processed for the purpose of ranking players and their results in the Contest.

Processing of personal data based on legitimate interest

  • The Controller may publish a list of winners on the website www.victoriavr.com or on its social networks, including the nickname and the Time in the game, for the purpose of promoting the Contest and the activities of the Controller. This will contribute, among other things, to making it apparent to anyone that the Contest was actually held and was not fictitious.
  • In principle, publication to the extent of the nickname and the resulting time in the Contest should not allow for unambiguous identification of the winner, but in exceptional cases this cannot be excluded. Should unambiguous identification be possible, the recipients may be any visitors to the listed websites and social networks of the Controller.

AMENDMENTS

Occasionally, it may be necessary to modify this EULA for significant reasons, such as incorporating new features and capabilities of the Product, or to adhere to legislative changes.
We will notify you about specific amendments and your right to reject them in advance via the Product. Should you disagree with the modifications, you have the option to terminate the EULA and discontinue using the Product. Your continued usage of our Product after these changes are implemented will be deemed as your acceptance of such changes.

PROCESSORS, RECIPIENTS AND TRANSFER OF PERSONAL DATA

For the effective operation of the website and our company, we have contracts with other service providers to whom we may pass your personal data for processing. In particular, the following may process your personal data:

  • software and IT service providers (e.g. Google, Microsoft),
  • marketing service providers,
  • post office,
  • legal service providers.
We process your personal data exclusively in European Union countries. Outside of the European Union, we might process your personal data only if it is necessary for the performance of our contractual or legal obligations.

STORAGE TIME

We process personal data only for the time necessary to fulfil the purpose of processing or for the time required by law. The storage period varies depending on the legal title of the personal data processing:

  • If the legal title for the processing of personal data is the performance of contractual obligations, we process personal data for the Contest period and then 1 year after the Contest period is over.
  • If the legal basis for the processing of personal data is the fulfilment of our legal obligations, we process personal data for the period of time required by law.
  • If the legal basis for the processing of personal data is our legitimate interest, we process personal data for the duration of the legitimate interest, or until you notify us that you do not wish us to process the personal data further.
  • If your consent is the legal basis for the processing of your personal data, we will process your personal data for no longer than the duration of your consent.

YOUR RIGHTS

In particular, you have the following rights in relation to your personal data:

  • Right of access to personal data - you can contact us at any time to ask if we are processing your personal data and, if so, to request further information about this processing.
  • The right to correct or supplement personal data - if your personal data changes during the processing or if you feel that the data we process is incorrect, please contact us.
  • Right to request restriction of processing - in the cases referred to in Article 18 of the Regulation, you have the right to request restriction of the processing of your personal data.
  • Right to erasure of personal data - in the cases referred to in Article 17 of the Regulation, you have the right to request that we erase personal data concerning you without undue delay.
  • Right to request data transfer - under the conditions set out in Article 20 of the Regulation, you have the right to ask us to transfer your personal data to a third party.
  • Right to object - where we process your personal data on the basis of our legitimate interest, you have the right to object to such processing at any time.
  • Right to lodge a complaint - if you have any doubts about our compliance with our obligations related to the processing of personal data, you have the right to lodge a complaint with the Office for Personal Data Protection

OTHER AND FINAL PROVISIONS

If you refuse to provide personal data necessary for the above purposes, we may not be able to provide you with our service.
Our company does not carry out any personal data processing activities that involve profiling.
We process personal data via software, so the processing is at least partially automated.
This Privacy Notice is effective as of 09. 02. 2024.
