CQB END USER LICENCE AGREEMENT

INTRODUCTORY PROVISIONS

This End User Licence Agreement (or “EULA”) governs the relationship between you (“user” or “you”) and Victoria VR, a.s., registered number 09695346, with its registered seat at Václavské náměstí 796/42, Nové Město, 110 00 Prague 1, Czech Republic, registered at Municipal Court in Prague, file number B 25843 (“Victoria VR” or “we”) in relation to our game CQB Training Arena („Product“).
Before beginning the installation of the Product or starting to play the Product on a streaming platform, you must acknowledge your consent to this End-User License Agreement (EULA). Should you (or your parent or legal guardian if you are under 10 or have limited legal capacity) not accept this EULA, you are then prohibited from using or accessing the Product.
In the event that you allow your minor child or legal ward to utilize the Product, your agreement to this EULA is considered as made on behalf of both yourself and them. It is your understanding and agreement that you bear full responsibility for any and all usage of the Product by your child, and that this responsibility is akin to that which you hold in your personal affairs. Furthermore, you commit to ensuring that no individual under the age of 10 will use or access the Product without the direct supervision of a parent or legal guardian.

LICENSE TO USE THE PRODUCT

The Product encompasses a diverse array of content which includes, but is not limited to, software, technology, text, posts in forums and chats, profiles, widgets, messages, links, emails, music, sound, graphics, images, video materials, as well as its design and appearance (“Content”)
By agreeing to this End-User License Agreement (EULA), you are granted a personal right, known as a "licence", to download, install, and use (play) the Product for the duration that this EULA is effective between you and us.

This licence is characterized as follows:

  • "non-exclusive", implying that we can extend similar licences to others;
  • "revocable", indicating our ability to terminate the licence under specific conditions detailed later;
  • "personal", which restricts the use of the Product to non-commercial purposes;
  • "non-transferable", ensuring that the licence is solely for your benefit and cannot be transferred or sub-licensed to others;
  • "limited", meaning the Product can only be used as outlined in this EULA;
  • "non-perpetual", signifying that it will cease under certain conditions mentioned in this EULA;
  • and dependent on your adherence to this EULA.

You are prohibited from:

  • copying or downloading any Content from the Product;
  • distributing, publicly performing or displaying, leasing, selling, transmitting, transferring, publishing, editing, copying, creating derivative works from, renting, sub-licensing, making available to the public, decompiling, disassembling, reverse engineering, or otherwise unauthorized use of the Content;
  • commercially exploiting (i.e., for profit) any Content;
  • or removing, obscuring, or altering any copyright, patent, trademark, or other proprietary rights notices attached to the Content.
We do not assure the constant availability of any Content, in all countries, locations, or at any specific time, nor do we commit to offering any specific Content for a set period.
The Product, including its code, graphics, gameplay, user interface, audio, and other Content, contains proprietary information and materials safeguarded by intellectual property laws, including applicable copyright legislation. You acknowledge our ownership or licensing of this proprietary information and material and agree not to use or exploit it without our permission.

PROHIBITED ACTIVITIES

The following actions are prohibited while using any of our Product:

  • Spreading content that is offensive, damaging, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or discriminatory;
  • Any illegal activity or encouragement of illegal activity;
  • Discussion or encouragement of suicide;
  • Spamming;
  • Advertising in any form;
  • Discussion of social, religious, or political issues that may cause offense;
  • Obtaining and posting identifying information about oneself or others;
  • Defrauding other users, including through scams or social engineering;
  • Transmitting any content that contains a virus, corrupted data, malware, Trojan horse, bot, keystroke logger, worm, time bomb, cancelbot, spiders, spyware, extraction tools, mining programs, or other computer programming routines intended to damage, detrimentally interfere with, secretly intercept or mine, scrape, or expropriate any system, data, or personal information;
  • Performing, soliciting, or assisting with a distributed denial of service (DDoS) attack against the Product or any user;
  • Creating, using, making available, or distributing any unauthorized software or tools, including hacks, cheats, exploits, scripts, bots, trainers, automation programs, or other software that interacts with a Product in any way and for any purpose, including intercepts, emulates, or redirects any communication between such software and us;
  • Creating, using, making available, or distributing any software designed to modify a Product and change the user experience ("mods");
  • Accessing or attempting to access areas of a Product or Product servers that have not been made available to the public;
  • Impersonating any person, business, or entity, including employees of Victoria VR;
  • Disrupting the normal gameplay, e.g., by self-destruction, damaging your teammates, blocking your teammates, passive play, or early exit from battle;
  • or Circumventing enforcement and security measures implemented by Victoria VR.

AMENDMENTS

Occasionally, it may be necessary to modify this EULA for significant reasons, such as incorporating new features and capabilities of the Product, or to adhere to legislative changes.
We will notify you about specific amendments and your right to reject them in advance via the Product. Should you disagree with the modifications, you have the option to terminate the EULA and discontinue using the Product. Your continued usage of our Product after these changes are implemented will be deemed as your acceptance of such changes.

TECHNICAL REQUIREMENTS

You need the following minimum hardware and software capability (including a suitable connection to the Internet) to use the Product:

  • Supported Devices MetaQuest 2
  • Supported Devices MetaQuest 3
Please make sure you meet such technical requirements before installing/using the Product. The graphics quality in the Product may differ depending on your settings, hardware capabilities, and Internet connection.

RULES FOR USING VR GLASSES

As you will be using the Product through virtual reality goggles, you are required to follow the goggle manufacturer"s instructions. Victoria VR will not be liable for any injury caused by defects in the glasses or improper use of the glasses.

CLOSING PROVISIONS

These terms of use and the legal relations between you and Victoria VR are governed by Czech law. This is without prejudice to the rights of the consumer under generally binding legislation.
In case of any disputes relating to the interpretation, performance or validity of this EULA, an amicable solution will be sought before any legal action, unless otherwise required by the laws of your country of residence. In the event that amicable solution is not reached, the courts of the Czech Republic with local jurisdiction according to our registered office shall have jurisdiction, unless otherwise required by the laws of your country of residence.
According to Czech Act No. 634/1992 Coll., on Consumer Protection, if you are consumer you have the right to out-of-court settlement of a consumer dispute arising from a consumer contract. In such a case, you may contact the Czech Trade Inspection Authority (Central Inspectorate - ADR Department, Štěpánská 15, 120 00 Prague 2, email: [email protected], website: adr.coi.cz). Online out-of-court dispute resolution can be initiated through the ODR platform, available on the website ec.europa.eu/consumers/odr/.
The provisions of this EULA are not intended to exclude or limit the rights available to consumers under the relevant provisions of applicable law.
If any part of this EULA is held to be unenforceable, then it will not affect the enforceability of any other part of this EULA. Also, we and you agree to interpret the rest of this EULA in such a way as to reflect your and our intentions in this EULA as far as possible.
We are operating on the basis of a trade licence. Supervision is exercised by the Trade Licensing Office and, to the extent defined by law, by the Czech Trade Inspection Authority, to which the user may address any complaint.
